PO001: Special Education Due Process Hearings: Exploring Factors

This study describes factors New Jersey administrative law judges consider when deciding special education due process hearings. The researcher examined judges' consideration of student Individualized Education Programs (IEPs), placement in the least restrictive environment (LRE), and case outcomes. Findings were consistent with prior research suggesting that school districts that develop compliant IEPs and place students within the LRE win in court more often than they lose. Additional considerations include witness testimony and documentation.
